US Supreme Court Decision in MNN v Halleck

This is the opinion of the US Supreme Court in which the majority opinion, written by Justice Brett Kavanaugh, with dissenting opinion by Justice Sotomayor, joined by Justices Ginsburg, Breyer and Kagan, ruled against public access producer Halleck, stating that “being regulated by the State does not make one a state actor.”  The question was whether or not Manhattan Neighborhood Network was a “public forum,” and hence needed to respect the First Amendment free speech rights of volunteer producer Dee Dee Halleck. The Court ruled that MNN was not a public forum with First Amendment protections of its “speakers,” because it was not a “state actor,” such as might be the case for a City.
